PrizeX hosts material uploaded by its users — listing photographs, descriptions, profile pictures, attachments and files. We respect copyright and we respond to properly made notices of claimed infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) and the equivalent law where you are.
Reporting copyright infringement
This site has not yet published a designated agent. If you believe material here infringes your copyright, contact us at hello@wowcodes.in and we will act on your notice. (Site operator: designate an agent and publish their details under Admin → Settings → Copyright & DMCA.)
For us to act on it, your notice must include all of the following:
- A physical or electronic signature of the copyright owner, or somebody authorised to act for them.
- Identification of the copyrighted work you say has been infringed.
- Identification of the material you say is infringing, with enough detail for us to find it — a direct link to the page is best.
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate, and — under penalty of perjury — that you are the copyright owner or authorised to act on their behalf.
A notice missing any of these may not be enough for us to act on, and we may come back to you for the missing part. Please note that under 17 U.S.C. § 512(f) somebody who knowingly misrepresents that material is infringing can be liable for damages, including costs and legal fees.
What happens next
- We acknowledge your notice.
- If the notice is complete, we remove or disable access to the material, usually within a few business days.
- We tell the person who uploaded it that the material has been removed, and pass on your notice.
Counter-notices
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address. It must include your signature; identification of the material and where it was before removal; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your name, address and telephone number, together with a statement consenting to the jurisdiction of the federal court for your district (or, if you are outside the United States, any district in which we may be found) and that you will accept service of process from the person who sent the original notice.
If we receive a valid counter-notice we forward it to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. In practice:
- Each piece of material removed following a valid notice is recorded against the account that uploaded it.
- Material restored after a successful counter-notice does not count.
- An account that accumulates three such records is suspended, and the balance held in it is dealt with under our Terms.
- A single flagrant case — for example, a seller listing an entire catalogue of somebody else's work — may end an account immediately, without waiting for three.
We may also remove material, or suspend an account, where we have a good-faith belief that it infringes, whether or not we have received a notice.
